1. Acceptance

By accessing or using surfbreaktheory.com (the "Site"), operated by Schut Enterprises Inc. ("we", "us"), you agree to these Terms of Service. If you don't agree, don't use the Site.

2. Eligibility

You must be at least 13 years old to use the Site.

3. Acceptable use

• No unlawful, abusive, or fraudulent activity.
• No scraping, reverse engineering, or attempts to disrupt the Site.
• No uploading malware or content you don't have rights to.

4. Intellectual property

All Site content — including the Surfbreak Theory and Global Surf Travels names, logos, maps, copy, design, and code — is owned by Schut Enterprises Inc. or its licensors and is protected by intellectual-property laws. You may not copy, redistribute, or create derivative works without written permission.

This includes the coordinate-only location identification system, GPS coordinate designs, and break intelligence methodology proprietary to Surfbreak Theory.

5. User submissions

When you upload photos, videos, or other content via the Site, you grant us the rights described in the Media Submission Release, which is incorporated into these Terms by reference.

6. Trip inquiries

Submitting a trip inquiry through Global Surf Travels is a request for information, not a booking or contract. Trips, pricing, and availability are confirmed only through a separate written agreement.

7. Surf, weather, and travel disclaimers

Surf forecasts, swell alerts, break information, and travel suggestions are provided as-is for general guidance. Conditions in the ocean change rapidly. You are solely responsible for assessing your own ability, local conditions, and safety before paddling out or traveling. We make no warranty regarding accuracy, safety, or availability. Forecast data is directional in nature and should not be used as the sole basis for travel, safety, or surf decisions.

8. Third-party links

The Site may link to third-party websites or services. We are not responsible for their content or practices.

9. Limitation of liability

To the maximum extent permitted by law, Schut Enterprises Inc. and its affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Site.

10. Indemnification

You agree to indemnify and hold Schut Enterprises Inc. harmless from claims arising out of your use of the Site or your violation of these Terms.

11. Governing law

These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law principles.

12. Changes

We may update these Terms from time to time. Continued use of the Site after changes means you accept the updated Terms.
